Brother making trouble again
My brother is threatening to take me to court "again". My father passed away 3 years ago. I was the executor. my father was in the process of getting his will done. He ended up in the emergency room and died on the operating table, but, he signed the will the day before and asked me to do the rest because he couldnt bring himself to. He told me that he knew I would do the right thing. So in front of my brother and other witnesses, I typed the will up and my brother agreed to everything right there. Now, ever since he found out that my father had left me his savings account, he has been doing nothing but harassing me. He also got in touch with a long lost sister(who was put in the will to claim $1.00 and I had to fight him on that) who he has hated and has been threatening to put in jail for securing a loan in his name (forged). Now they are buddy buddy. The reason I think that is, is because she has some $$ and wants her to pay for the attorney and I guess then he won't put her in jail.(blackmailing) She is supposed to be securing an attorney.I have been released from my executor duties as of Sept 2006. Probate is done but, we are waiting to sell my father's house in Florida. My sister has supposedly sent my brother emails saying that the house should be put in his name only. (we are listed as tenants in common). I have about $30,000.00 invested in fixing up this house as there was a leak that flooded the house. Plus other repairs to make the house sellable.(of which he has not helped at all physically or monetarily) Going over some probate papers recently, I read something that he received a copy of and signed, that if there were any interested parties that had or wanted to make any claims they had 90 days to do so or forever be barred from any legal action. Does that mean him also? The real estate contract is up tomorrow 02/22/08 and he is refusing to sign an extension of contract. That probate document was from April of 2006. Does he have any recourse? and, can I force the sale of the house with or without him? With all this aggravation, I feel like I'm going to have a nervous breakdown. Can someone please help? Thank You so much.

Nancy,
I have no advice but thought I would write and let you know you have my deepest sympathy and that you are not alone . Several years ago I took my mothers estate through probate without an attorney and my older brother was co-executor. It ended up being a year and half of living hell. But I did get through it, even after many of his shenanigans. Maybe a little time Meditating and Relaxing would help and try not to get too mad. Good luck. jplot |
