Default Unsigned will and estate

When my father passed away he didn't leave a signed will. At the time of his death, his brother was living in a trailer on the property. Does he have more rights to the estate than the heirs since he was living on the property still?

Not really as a pure legal matter--the estate has to be passed according to state law at this point. But you will have to evict him in court if he will not leave.

You may have other family considerations here apart from the law.

You should not have to pay that unless you hired him?

Who hired him?
