Stopping a probate for fiduciary fraud
My daughter is 31. When she was about 12 her grandparents gave her shares in some apartments. She was sent K-1 tax forms every year. We were told the income would go to the grandparents until their death. Grandfather died in 2006 and the Grandmother dies in 2007.
We thought after the two had died she would "come into" the income. She wasn't an heir or beneficiary of the trust. Notice of the trust was sent out to all 9 grandchildren, daughter and son. My daughter is grandchild #10.
When my daughter was still a minor the Grandfather asked me for a power of attorney so he could sell and reinvest her shares. He said he would take care of the K-1's. FORWARD in time......the deceasedis daughter is the trustee and when I found out my daughter was not getting her shares I was told that the transfer probably occured more than twenty years ago and that "he had the right to change his mind." WOW.... I trusted her grandfather. This is fiduciary fraud....... In two days there is a notice of hearing-Decdent's Estate or Trust. What document can I file to halt all proceeding? I understand my daughter did not have to be notified because she wasn't an heir or beneficiary. Notice of the hearing was sent to my daughters Dad and she happened to see it. The trustee states clearly this issue has nothing to do with the estate and to let it go as it was the grandfathers wishes NOT to leave her anything. YES, I agree. But what about what she was "GIVEN".
FYI-I called the attorney that represents the trust and left a message. She called back and talked freely with my daughter telling her this issue had nothing to do with the trust.
