Confused Executor refuses to execute will

Mother & father both passed away 2005,Will states property to be dispersed in an even 3 way split,Myself,my sister & 1 grandaughter whom my mother raised.Brother in law & sister have since allowed their daughter (not in Will) into parents home, assuring us 2 years ago that their daughter would purchase the home, still NO SALE.In meantime their daughter is receiving rent for another property she owns, yet living rent free in my parents house, they have ripped out established 20yr old gardens, are building Gazebos, sandpits Ect Ect. all with knowledge & consent from the executor (my brother in law).My soloicitors advise so far is to just wait, surely something can be done to end this ongoing nightmare.Sick & tired of all the lies & BS,want to get on with my life & be able to remember my parents with a little bit of dignity & happiness, not the crap that is happening now.PLEASE CAN SOME HELP>WHAT CAN I DO.Regards Cheryl.

Default Re: Executor refuses to execute will

If two or more owners cannot agree on what to do with a piece of property they may petition the court and the court will order a sale or refinancing etc. so that the one or more may get out of the property obligation and/or the other(s) may keep it etc.--it is often done-- (This is true in some cases even for equitable owners that have paid various amounts etc., but for various reasons, may not be on title.) You could threaten to take this action if need be. It may cause compromise which is of course what you need here now.
