Is the lack of acting/distributing the estate breach of executors duties?
Is then the lack of access to information regarding accounting of assets while the executor was also power of attorney, and while executor breach of duty. Will has not been probated, no information, release requested and no information re expenses etc paid out and actual balance to date. Please advise Thanks in advance |

Unless there is good reason then yes you could file in court (or threaten to do so) and argue the executor is not fulfilling his/her duties--and a court could remove them if need be.
