My parents owned a property (bare land) in joint tenancy, in California. Mom died, and Dad didn't remove her from the deed. Then Dad died. They had each made a pour-over will, leaving everything to their trust; but they hadn't changed the deed on the property itself, to name it to the trust. After
filing an affidavit of Death of Joint Tenant for Mom, what forms must I file to get the property deeded in my (his child's) name? I'm also his successor trustee, and have the affidavit of successor trustee, and death certificates (I'm also named executor in his will, but I haven't petitioned for Letters Testamentary). This is an inexpensive property, and so I'm looking to resolve it through inexpensive means, if possible. Thank you- |

You really should have a real estate lawyer prepare the deeds for you. The cost will only be a few hundred dollars but it is well worth doing correctly. And he has to see the documents.
