Default Wills, Estates

Dear Sir/Madam:

I am an heir to my late dad's estate and am having difficulty signing off
on my share of the property. My brother, the executor, wants my
sister and I (only 3 heirs) to pay for repairs to the house even though he
and his wife have lived there for 12 years.

No receipts for their share of the mortgage have been seen, even though requested. I cared for my dad for 12 months and he expired June, 2006. Now my brother is trying to get the Commissioner of Accounts to "approve a proposed sale of the real property" to my brother.

Why should my sister and I pay for repairs when he and his family lived there (and did not help with the care of my dad when I was there.) In fact my dad was concerned that my brother had taken money from him (power of attorney) but he was too afraid to have me confront my brother while he was alive. He just stated that since I had moved in I could now \"fight\" for me and my sister. Do we have to pay the repairs?

My brother is in a real hurry to have the Judge rule on this.

If two or more owners (and you are now an owner as well) cannot agree on what to do with a piece of property they may petition the probate or other court and the court will order a sale or refinancing etc. so that the one or more may get out of the property obligation and/or the other(s) may keep it etc.--it is often done-- You could threaten to take this action if need be.
