Hi, I set up a revocable trust many years back and now I don't need it and have taken out all assets. Is terminating the trust as simple as writing a note to that effect and then tearing up the trust document?

The trust itself should describe the procedure for termination. Check the doc closely as a first step.

Thanks and you're right of course. it says it's revocable only by written instrument executed by the Grantor and Initial Trustee with all of the same formalities as accompanied by the execution of this instrument.
Since I'm both Grantor and Initial Trustee, does that mean that I have to get two other witnesses (like the trust has) and just write something about how it's revoked now? Sorry to be so dense but I think you've already basically answered my question! |
