Angry crooked brother took his sickly grandmother to a lawyer

My wife lives in the U.S. and her brother in Trinidad took his sickly grandmother to a lawyer to have her unknowingly sign a new will leaving all property to him. There's a witness to the fact that she was not aware of what was being done, and was being misled into signing the will. My wife as well as others in Trinidad need to know what if any are their options to overturn or contest this will? And what are the steps to do whatever their course of action may be?

I wish to inform you that your wife will need a court order regarding the fact that your sister can obtain a court order that Will should be declared as void. The Will can be declared as void on the ground that Will has not been made by grandmother by free will or with consent. Your sister can produce evidence in court that brother has misled the grandmother.

If there was undue influence to sign the will, a witness to that fact, and the grandmother is still in control of her faculties, she is able to make a new will. Someone needs to talk to her and find out her mental condition. She needs her own lawyer if competent or a guardian if not.

The first thing to do is find out from her first hand what the circumstances were surrounding making the will. If competent, she can make a new will and if not, a guardian needs to be appointed for her once she is determined to be incompetent through court proceedings and the will disavowed by the court during those proceedings. Otherwise it will stand.

She has passed away. We are trying from here to have them get a statement from the witness and insure she is willing to make any appearance necessary. She is the only firsthand witness of the conspiracy. She found out at the lawyer's office and decline to be a party to it. They are also looking to speak with the doctor to give his statement of her competency.
