Default Brother passed W/ no will (we are his only surviving family)

My brother passed away in 2010, with no will and me and my two brothers {we are his only surviving family} were wishing to claim money he has in a wells fargo bank account. I have already acquired his death cert from the los angeles coroners office and I live in SW Fla. Can you tell me how to get these funds released to me and my brothers? Thank you David

You can open a probate case in the circuit court in which he passed away. They will determine his assets and liabilities and distribute to his family in the line of descent.

None of you live in CA?

Once probate is opened, any debts your father had will be settled first. That means if debts owed add up to more than what's in that bank account, you won't get your hands on it anyway.

An attorney can act for you. Call one and have one represent you in that court.
