This case takes place in the state of Georgia.
- My great uncle died and left a will and trust. His will says to leave the trust 50% to his college alma mater and 50% to his wife's heirs. - It appears that my uncle left everything to my aunt if she survives him. - more than 10 years later my great aunt ( my great uncle's wife) died and left a will that says the trust should go 50% to her husbands alma mater and 50% to two surviving nephews only. - there are a total of 18 heirs listed on a family tree. - My great uncle also leaves a house and some property. - The lawyer (who is not an estate lawyer) is sending everything to probate. - He is also contacting all of the heirs to notify them of the trust, which is not a part of my aunt's will. - My question is why can't the trust be distrubuted as my aunt has requested ? - Should everything have to go to probate? |

You need to have an estate lawyer look at th will and the trust and determine how this should not be handled. Any term in the will or trust could affect the outcome. You cannot know the outcome without the documents carefully reviewed.
