The PA Statute entitled PA Probate, Estates and Fiduciaries Code states; "A joint account belongs, during the lifetime of all parties, to the parties in proportion to the net contributions by each to the sum on deposit, unless there is clear and convincing evidence of a different nature".
My question is this: is there statute or code in the state of Florida similar to this? This would refer to a money market account in the name of a father and his son. All monies in the account are the fathers. Son was added as a convenience, but it is the father "or" the son listed on the account. Thank you |

The father lived in pa and the son talked him into selling his home and moving to FL with him, with the promise of a new home waiting for him. The father spent approx. one month in the son's home, while awaiting the renovation of this promised residence. the son convinced the father to place his name on his money market account, which contained proceeds from the sale of his home in PA. One day the son told the father it was time to go to his new home. The son dropped his father off at an assisted living facility and left. With no where else to go, and no visits from the son, the father remained at the facility for 2 months. The son was still in possession of his bank ledger books. The facility was able to retrieve these for him and the father "ran away" from the facility and returned to PA. When the father tried to access his account to purchase a car he realized that his son had drained the account.

--he absolutely can sue for that no matter what the account said or what kind of account it was--the son defraused the father and most courts will clearly see that. We see this issue all the time.
