Recently my father passed away. My brother and I were his only children. He had very little in his estate, but would his "wife" (my brother's mother) be entitled to a share. They were married over 30 years ago and there seems to be an issue as to whether they ever got a divorce (I'm trying to find out through public records). I'm more than willing to divide his estate with my brother, but I feel that his mom should have no claim since they were only physically together for about 10 months after my brother's birth (meaning they haven't been a couple for more than 30 years). Is there any legal action I can take? I'm sure it depends on the state....

If they were still married she normally would be entitled to a share by law-- yes.
