consevatorship

My mother has had a history of mental illness, of 47 years. My father passed on Jan 19, 2007. My estranged brother from out of state came in and took over my mother's finances. I was the executor of their living trust account. My mother recently is in the hospital under 72 hr evaluation. My brother has locked me out of the house. She is incompacitaed. How do I gain conservatorship or power of attorney. I do have a signed executorship by my mother, when she was in a lucid state, giving me full power to handle their/her estate. My brother has taken advantage of my mother's condition and I have no idea what she has signed at this point and what may be in the works. I have always been the caretaker, and am very knowledgable in her metal illness history. I just want to see my mother well taken care of and he refuses to come back to help her and she is incapible to live on her own. I do not have access to her financial or medical information. I had her sign a medical authorization, to which has dissapperared since his visit. Her close friends and neighbors who have looked over her on a daily basis are all in agreement with me. What can I do?

If you suspect any wrongdoing you can have a court intervene and rule as to who should be in control.
