Default common law marrige rights

I have a friend who's girlfriend that he lived ith for 2 years was killed in an auto accident. She pawned his lap top but the ticket was destroyed in the wreckage. How can he legally get the computer released to him from the pawn shop? Also even tho they were not married they were common law married in the state of texas...does he not have rights as the next of kin?
