My children were willed money from their grandfather. My ex sister-in-law is a trustee for the accounts until they are 21 (my son will be 21 this October and my daughter is 18). They have requested information regarding where the money is currently deposited and statements on interest/accounting. The trustee has ignored all requests as has her lawyer. We live in NJ and the trustee is in Colorado. We are very fearful that when the time comes, there will be nothing left or it will next to impossible to get released. The trustee was removed as executor of the will because she did not take any steps to probate the will or provide accounting for several years. Upon agreement among the beneficiaries, thousands of dollars were "written off" to settle things after four years of ligitation, since she had no records or accounting for the money. Are the kids (18 and 20) entitled to any sort of monthly statements or information as to where the money is and what is happening to it? The lawyers never even requested SS numbers for the kids accounts and I would think that they would have needed these to open them. She is also trustee for her brother's (my ex-husband's) share of the estate (his father did this because he has addictive problems) and she skipped monthly child support//alimony payments even causing him to be arrested. We are fearful of what might happen to this money and don't have the means to retain legal help to get information. What is she legally obligated to provide to the kids as trustee of their accounts?

There must be periodic accountings given.
If you suspect problems then file in court to force her to divulge all info and remove and fine her if she took funds. I am sure the attorneys at this site could help you file, even by yourself if need be. |
