My sister's husband died intestate. They lived in Waco, TX. They were together over 30 years and married for 10-15 of those years. The home they lived in was purchased from her deceased aunt's estate and was put in his name alone. Since his death and after probate she has been told that she must pay and insurance policy, yearly, to protect the home and property from being sold out from under her by his siblings, half-siblings and/or their descendants. Does she have to continue paying this policy or does she have other legal recourse? She has not been approached by any of the said individuals in the 5 years since his death.

If it was her aunt, why was the property deeded in his name only? If they were married, they should have been listed on the deed as Joint Tenants.
If he died intestate, and nobody has petitioned Probate Court, naming someone as Personal Representative, she is under no obligation to pay anything on the house or live there. |
