my brother pasted away on oct. 21st 08 and "we" the family have not seen a copy of the will or living trust. his x-wife and daughter are the only two that have seen it. we would like to know how we the family can get a copy of it.

As heirs, you can go to Probate Court. I'd consult with an attorney on this one. Wills and Trusts are not usually filed with the courts. They are usually left with an attorney or placed in a safe deposit box or somewhere safe within the home. They are not required to be filed with the courts so it's nearly impossible to obtain a copy.
This is where consulting an attorney comes in handy. Probate Court is a good option and your attorney may be able to ask the judge to order your stepmother to show you the trust/will. |
