Question Removing Sister as executrix

This is the last thing I want to do but my arm seems to be twisted and I am at the end of my rope with this going on so long. Any input on what my next steps should be would be greatly appreciated.

Long story short. My sister is the executrix of my mother's will and it is going on 3 years since my mother's death and will still isn't finallized. Everytime we try and talk to her about it she makes up excuses to why its not finished or she says she hasn't had time to do anything. The taxes have been paid and her estate was not large at all. I am the alternitive executor to the will and my siblings are asking me to remove her as the executrix. How would I go about doing this and what should we do??? Any info would be great.

My mother is having a similar issue. Even though there is a will, the majority of the siblings can contest it and have the executor of the will change if that person has done something illegal and some wills are written to state that no property can be sold or divided without permission from the other siblings. If the executor is leasing the property out and making money off of it, this will be illegal in some cases. Also, make sure that it is the last will by having it probated. This "officially appoints the executor or some other person to handle the distribution of the decedent's property. Even if the will is not going to be probated, anyone who is in possession of the will of an individual who has died must bring the will to the Probate Court for filing". I hope some of this helps...I am still learning.

WjEPfI'm having that trouble in a way also but I want to remove my sister There is some underhanded dealings goin on. ANYWAY an executor may be removed if they are guilty of some sort of neglect to the property. Not just because you do not like them. This law is in Missouri. Hope this kind of helps. Also in Missouri there is a law RSMO Chapter 473.263 that says a executor can rent a property for 1 year, after 1 year something has to be done with it.
Thats all I been able to find out..Hope it helps a little. I know its hell having to deal with.
