My mother had a mentally ill son that died in Jan. of this year (2008). Her son was unable to work because of his illness. He died at age 66. Never worked during his adult life. He was cared for by his parents all his life. He started getting Social Security money after being declared disable in 1996. (54 years old) In Jan of 2004 he had a stroke and became paralyzed, and from that day, until he died, his 85 year old mother was no longer able to provide his care. Her son entered the nursing home system. Because having never worked, the Medicaid system for the state of Texas covered all his medical and nursing home expenses. Now because of his death the state of Texas wants to collect $100,300.00 (one hundred and thirty thousand dollars) from his estate. His had NO estate, his 89 yr. old mother, who lives on Social Security, does own her home. Will the state of Texas take her home now or later after she passes? That's my legal question. Does she need a lawyer to represent her in a probate court?

They should not have any issue as to her property.
If he had no assets the state will simply not get paid. |

Where do they heartectomies on these state employees? DOH! they're state lawyers they had their hearts and guts removed at the same time, AKA gutless wonders. He applied. qualified, and DIED unless these vultures can prove he had gains screw 'em. One day we will hunt them down. |

I found the law and it reads, The State cannot recover, The State cannot, cannot, cannot. All the way down to what they can. Seems to me they are positioning themselves to go after your mothers estate. I will find the law again and post it.

Medicaid Estate Recovery Also in the federal code ... any case can be reopened on the basis of fraud or mistake on the face of the evidence... We are talking about nursing homes, who feed in bed with a styrofoam bowl and a plastic s****. It probably wont be hard to find fraud. The state will have to provide every reciept if challenged. |
