Ihave been appointed personal representative of my father’s estate. One of the responsibilities is the collection and valuation of my dad’s assets.
My father's wife is still living and being cared for by her adult children. At present she is in a nursing facility and one of her sons plan to take her to live with his family when she is discharged. She has another son living in the home that she and my dad lived in together. The home is one of the assets that we plan to sell. How do I get him out? My dad's wife's granddaughter took their travel trailer. That too is an asset that we plan to sell. How do I get it back? The son that will be taking care of her took a vehicle of my fathers that is also an asset. He is using it for his commercial OTR trucking company. Diminishing its value with mileage wear and tear. Not to mention he is making a profit with its use. Does my Letter of Administration give me the authority to "collect" these assets that her children seem to think were just "up for grabs"? I am pretty sure that the items in the home have been unlawfully distributed among her children, including an old vehicle my dad was restoring in his garage, and many tools, air compressors, generators, and welding tanks. The list is huge. If I request the assistance of a police officer to come with me to "keep the peace" will that and my Letter of Administration be all that I need to retrieve my father’s assets? Yes the letter does give you that power, and the police normally will escort you if need be.

I tried to reclaim these assets before being appointed and I was told by the police that they could not "make" them return the items without a court order. My fathers wife's family members took everything because they insist it now belongs to their mother. When in fact it does not. When I confront these people they will demand that I have proof.
How do I prove that these are assets? |

If you don't have some kind of proof or evidence for the police then you could file in court and explain, and get that order from the judge.
