My Sister was just charged with assult in the 4th degree on a police
officer and has been given a felony. She has a clear record and no criminal history. The incident happened at a bar and somehow an officer received a scratch on his face there was no weapon involved. Is it likely that she will receive a jail sentence for this, and is there an option for pleaing the charge down? We have a lawyer, but this is in the early stages and we are very unsure what could happen. She has expressed extreme regret for the incident and is very shook up about it, any help would be greatly appreciated! Thank you. |

Make sure you or she keeps that legal counsel (or at least the public defender) to try to keep this off the record eventually--jail time is not likely if her record is clear now. But having that arrest and/or a conviction on the record could make job-hunting etc. more difficult. Often this could be negotiated down to some kind of court supervision or even be completely dismissed etc. If it eventually appears it cannot be negotiated down, please let us know...
