I have a 20 year old son that was arrested for possession and was in jail for 5 1/2 weeks. He had a court appointed attorney during this time. It was due to an illness that we decided to bail him out. At the final court appearance he plead guilty and did not take the 3 year probation that was offerred to him nor the go back to jail. He took a Jail Felony Conviction. At the last moment they fined him with his court appointed attorney fees of $890.00 and gave him 90 days to pay. He was indigent at the time he had the court appointed attorney and was not making enough money after he got out to pay the fees within the alloted time frame. Now it appears that this is in an Auxillary Court until January 8, 2008. What does that mean? No notice has been received that he owes this money. They only gave him an address to mail the payment to. What can we do at this point to keep this from going into a warrant if this already hasn't. He has taken all his hits for his 2 years of mistakes. This is the last thing that we need to clear up and I am not believing they can access him with court appointed attorney fees since he did not take probation and plead guilty and now has a felony on his record. This is a Texas case. Please help with advice as to where to go to get this matter taken care of.
Thanks Concerned Mom PS he has been sober and clean now for over 10 months has a job but just has been working for the last 3 months. We are finally getting somewhere and now we have to deal with this last thing. Please help. |

You could tryt o work out some pament deal with the prosecutor, if that has not been done already.
he public defender could also try to get the fines adjusted. Otherwise borrow or do what is needed but pay one way or another. |

I didn't know that Court Appointed Attorney needed to be paid.
I was under the impression that they are Appointed by the court because the defendant has no way of affording one. Am I wrong? |

It can be done both ways--some courts make you pay a portion.
