is the plaintiff due to appear in court in a grand larceny case??
hello,
my grandson has been charged with grand larceny, and he's going to have a preliminary hearing in 2 weeks, and due to the fact that he can prove he was not involved in the burglary, the plaintiff will not appear in court, and has already moved out of the State (he tried to frame my grandson). Now, our attorney says he will prove my grandson innocence at the trial, but he is also going to charge us over 20k. My question is: will the DA still try to send my grandson on trial if the plaintiff does not show up at the preliminary hearing to confirm his accuses, or will he drop the case? If the DA sees that the plaintiff was not being truthful, the DA should dismiss this.
