Exclamation When must an inmate be released?

The charge is Accessory After the Fact. The case to which the defendant was accused of being an accessory went to trial over two weeks ago and the case was dismissed. Should not the charges be dropped in the Accessory case, and should not this defendant be released immediately? The Accessory trial is set for Nov. 19. Can the Defendant legally be held until the trial date? Is there anything that can be done to start the ball rolling to get the charges dropped? The Defendant has no money and the case has been assigned to the Public Defender's Office. This case is in Ft. Meyers, FL.

Have you called the PD to discuss?

You should do so ASAP. Normally a release should occur but there are odd situations where a trial could still occur.
