Default refilling charges

The first criminal (misdemeanor) trial ended in hang jury.
Second trial ended in conviction.
Conviction was reversed on appeal.
The case is set for the third trial.
Should the charges be refilled after the reversal or the same charges filed for the first trial are still pending.
I f the charges should be refilled after reversal is there a time limit?

We are not quite sure what you mean. Do you want to file and if so what? Or are you questioning the filing and timing by the prosecutor or others?
