My husband has spent over 3 months in jail. He was accused of a crime he did not commit. The officer refused to investigate it afterwards. The guilty person has come forth and the state has agreed to drop all charges. We are waiting for my husband to be released, but he needs a court date to get in front of the judge. You think they would put a rush on it being he's trully innocent, yeah right. Anyhow, how successful would he be in obtaining compensation for the time he spent in jail? He's lost work, has been humiliated and now has anxiety and depression. It's ruined his credit of 820 and now he's going to have to file for bankruptcy b/c I couldn't keep up with the bills. I know we have to speak to an attorney, but really is it possible? What if you threaten to go to the media? What's the best way to go about it?

It is difficult to sue unless you can see that they purposely violating the rules. You cannot sue simply because he was innocent. Unfortunately.

The attorney talked to my dh today and said that he has a hell of a case against the cop. He didn't even mention it to her, she brought it to his attention! We'll see what happens.
