Default How do you present evidence in your case to the DA?

If the state hasn't gotten you a public defender, how long do they have? It's been a month since my husband has been in jail. He was wrongfully charged with a crime. We have the evidence including the guily person admitting it, video surveillance, and witnesses. The problem is my husband has no representation to submit it. We can't afford a lawyer either. What can we do?

Call the PD office as many times as needed and explain the situation and tell them you need help now.

You often have to be persistent.

My DH finally got a PD. I've been banned from the PD's office. I was told not to call there anymore and if I do, nobody is to talk to me or answer my questions! This is what my DH PD said yesterday.

That is because you are not the person on trial, but a third party. They only want to speak to the person they are representing. IF your husband needs to call them, he usually can do so from jail, or he can send them notice by coorespondance. I suggest he set up a meeting with his PD and list all the evidence he has that he is innocent.

He did that, but the PD was very rude to him! She was aggravated b/c she said that I keep calling to find out what's going on. I wouldn't have to do that if she would just sit down with my husband and tell him what to expect or what's going on. He can't call her either. I have to call to get any messages across. Now, she told my husband that I'm banned from calling there! She instructed everyone in the office not to answer my calls or me. It's so frustrating. We have no contact now at all! He said he felt like he was fighting against the DA when he spoke with her. When she met with him for 10 minutes, she complained about me for 5 and didn't answer anything. UGH!
