Default Charges (urgent)

My hubby was charged with fleeing the cops, DUI, and driving on a suspended license. The problem is that his friend was driving and jumped out of the truck and took off. Once the cops caught up, my hubby was sitting in the passengers seat. The cops charged him b/c they didn't see the other guy take off. The other guy says the cops know I was driving, but they are charging you to scare you. He said the cops are hoping you turn me in. My husband doesn't want to snitch. The other guys says if it comes down to it, I'll turn myself in. Meanwhile they are holding my hubby for all the charges and VOP. What can we do? His court hearing for the VOP is in a month. Does this need to get it resolved before that. We can't afford an attorney at this point. HELP!

The other guy needs to take responsibility or most likely your husband will be charged.

But have a lawyer consult both of them first....

There is no other way around this frankly.

I got a copy of the police report. It says when the officer pulled up, my hubby exited out the passanger's side of the truck. My hubby stated the driver ran into the woods. The officer did not see him. The officer noted there were 2 cans of open beer in the cup holders also. I spoke to an attorney and he didn't giv too much info except for he could take care of it for $4000. (Ouch!) If the driver comes forward at this point, how long before it gets resolved? Will it still be considered a VOP?

Does anybody think my hubby has a good chance a beating this if he takes it to trial? The driver was going to turn himself in, but now has decided not to. Reason being is he said I've done prison time and if I get another felony (fleeing), I automatically will do 10 yrs. He has openly admitted to myself, my son and three other people that he was the driver and he was the one who took off. Can all of us be subpeoned in my husbands defense? My husband will have the driver subpeoned also. How soon can they hear our side and do we have to wait for the trial? The cop never saw my husband driving or has never stated that. He stated when he aquired the car, my hubby was the only one in there, located in the passenger side. The cop also stated in the report that there were 2 open cold beers. It also stated that my husband said the driver took off into the woods. The cop refused to do further investigation. He said he arrested him b/c he was in actual physical control of the vehicle. Also, if anybody can describe that to me in more detail, I'd like to know the actual definition. My hubby is officially charged with 3 felonies now. 1) Fleeing 2) DUI 3) Driving on a suspended license. We are still waiting for a public defender b/c of a motion of conflict. The original PD already represents the driver in 3 open cases. Any suggestions would be greatly appreciated. We've already been told that the judge my hubby is going in front of does not give bonds, so that's a lost cause. I did briefly speak to an attorney and they said they could speed everything up and give my hubby a trail in 60 days from arrest. Is that true? Once agian we are in FL.

first of all if I am correct VOP is violation of probation correct? Did he contact his probation officer right away? If he gets arrested he violates his probation he goes to jail. now his supposed friend there should fess up. that my frriend is a loser and you dont need him at all. yes you all can be subpeoaned to testify.Good luck

Do you think if he goes to trial, he'll be able to beat this? If we all testify the driver admitted to us that he was guilty, will he get charged?
