Hello,

My husband has been charged with lewd and lulicious molestation upon a minor under 16. I live in the state of florida. He was arrested Dec 12 2006. 22 days from today. The only witnesses are My husband, My sister(the accuser) and I. When I was questioned I told the arresting officer that I could not remeber everything that happend that morning at the time but he took what I said and said that he was arresting him b/c he believes the "15 yr old". Which unfortanetly I already knew he would. The thing is I remeber everything now. It took 24 hrs but I remebered it. And I also remebered a certain statement she had made about a month and a half ago. She told my husband that all she had to do was tell my mom and dad he molested her and he would be gone. My mother knows of this b/c I got mad and told her and she got on to her for it. My husband did not comment this 2nd degree felony. In fact my sister even spent the whole day that day with him alone and that was suppose to have happened in the morning time way before I had even went to work. I don't want to make this long and be rude.... so my point is he's sitting in jail for no reason with a bond set at 40,000 that we cannot even afford. He was suppose to have been scheduled for his hearing/ bail reduction date today but b/c the prosecution has not filed the charges yet he wont have it until February 7 2007. Which would put him at 2 months already in jail. Nobody will talk to us and they wont appoint him a lawyer until february. I dont know what to do and am going crazy because I have a statement I have to give and the judge needs to hear before deciding it to go to trial. If there is anyway you can help me and maybe guide me a bit until We can get the public defender I would really appreciate it. I am trying to do the case, find a job and raise a 3 yr old alone. Please help me.

Also let me add that she is not an innoccent girl. Even my parents admitted to not being able to handle her anymore. She has been in trouble for missing so much school which does play a big factor in this case. and drugs at school. She has claimed to have been raped before while taking off to a party and getting drunk but of course nobody believed her. We all knew she was in on it. Also late at night she has been sneaking out of the house to meet her b/f that she told my parents she dumped to make them happy and goin out to do meth. My mom knows of her smoking pot.

I truely feel we can get this case dropped but I just can't get counsel no matter how hard we try. I hate that he is sittin their in jail b/c of her lie.

I won't contact my parents in fact they are actually kind off harrassing me. I done told them i was talking to them till this was over b/c it could hurt his case. I told them not to call me so they get someone else to call on their behalf. and then they even messenge me when they see i am on yahoo messenger!

This case is bull and given the right time I know we can prove it b/c they have nothing but her word. My husbands background only consits of 2 misdemeanors of worthless check which have been all paid in full. there has never been any sign and i have try to remeber red flags. Never any sign of him ever doing anything like this. You dont just wake up one day and say i'm a predator. He is 25 yrs old.

Some things i mentioned about my sister my parents dont know like the meth and sneaking out. And the acusation didnt take place until an hour after my parents got home and my husband let it slip to my dad that she didnt go to school and there was a big argument then all of a sudden "he fondled her breast that mornin?!! Its ridiculas and clearly done out of revenge.

If it did happen why didnt she call someone?? instead of spending the day alone with him (which this was normal)

Why didnt she ask me when i talked to her that day to not go to work AND TELL ME??

I cannot wait till february to give my full statement I will go crazy!!
But they wont appoint him a lawyer till then. And until that happens NO one will talk to us we have tried.
