Default ID fraud

Hi, all
I am trying to post this as short as possible. 2004 I opened a college checking account in my name, but mistakenly gave my daughters social (we have similar names and our cards have the same name on them) I also gave my schedule from my college which had MY social on it. Bank caught error and closed the account. It would have been no problem for me to keep the account open, but lady had such a bad attitude I just took my money and left. FFW 2007 DD came to live with me and wanted to open bank account and couldn’t had to do with the account that I opened and was closed in 2004. We go to the bank together to get it resolved and all they could say that it was not a charge off, but only reported as possible fraud since the social security number discrepancy.

About 3 weeks ago DD and I got into argument. I ended up finding out the hard way that she filed a police report accusing me of identity fraud; report says I ruined her credit and cannot open a bank account because of this. Which is a lie because she has NEVER seen her credit report. I have and there is NOTHING on it that she didn’t do herself (credit isn’t to bad, just 2 collection accounts) Five days after all this she learns she is pregnant, sends me texts telling me she loves me and intends to drop the charges. I know the state will try to pick up these charges and now I have to take a 2nd mortgage my house to hire an attorney who knows what he is doing and take care of this mess.

I have proof that she did all of this on purpose to hurt me, because she was mad at me. She truly needs some kind of psychological/counciling help. This is a felony they are trying to pin on me. The attorney that I am going to hire says the case is weak. Any help/advice is appreciated.

Did I use DD SSN? yes, by accident-
Did I intend to defraud or cause harm? NO, it was a simple mistake. All the other info was mine, my DL and my school schedule which shows my SSN
Did I gain anything? NO

I have perfect credit, perfect banking record. Only thing is I made some mistakes when I was young 17,18 and that would be the only things I would see that they could try to use against me. I have waaayyyy to much to lose to even consider doing this on purpose.

Mistakes are mistakes, most courts are understanding. If your socials are very similar, then you can show that and evidence that it was a genuine error and not a criminal act.

Seek defense though, it's foolish to represent yourself in court even if you're well versed in legal matters.
