Default rape or date rape

I am male, and when I was 14 my male best friend and I got drunk and he passed out. I attempted to perform oral sex on him. I'm not sure whether or not I wanted him to wake up. I stopped and started again. His penis remained flacid the whole time. He woke up a few minutes after I stopped, but he may have woke up during this act. There may been a witness passer-by, who only seemed to notice that he was passed out, and there was broken glass from us. My friend may have signaled him to call the police. When we were headed back to my house, he said he was going a different way and I kept going. I police officer, apparently, noticed me stumbling and stopped me. I denied being drunk repeatedly even though it was obvious. He waved a pen in my face and by that time my fround came around the corner, apparently unable to utter his name. I said I didn't know him, hoping I could get off the hook. He called our parents and I never saw my friend again.

What could the sentencing have been had my friend woke up while I was doing this? What if he didn't wake up? Did the officer pretend to see what I'd say? What if that passer-by called the police? Is it rape if he woke up?
