Default need some help here

ok my stepfather was working as a Fill-in for a worker at my uncles job.He was emptying a shack outside with bikes that nobody owned(which he was told to do).So his boss says to him he can have whatever bikes he wanted, he can pick them up anytime. Since he was in the process of moving he left the bikes for a later date which happens to be last march.He and my mother decided to pick up 2 bikes which was in a boiler room in the buildings basement(which is where he put the bikes from the shack).So they took 2 bikes and was seen by a security camera.

It Turns out those 2 bikes belonged to the worker he replaced while working there.The worker calls for an investigation and my mother and stepfather was notified by me(from my uncle) that those bikes belonged to the guy working there. So my mother and husband went to see the man personally and gave him the bikes back and in good condition.He wrote a letter saying to them that the bikes were returned in good condition and he wants to drop the charges.ok so my mother and husband go to the police station to see the detectives and to tell them everything was settled and it was all a misunderstanding.Problem is the detective did not want to drop the charges and wanted to proceed.The boss which offered him bikes and the worker both go down to the police station to tell the detective that they want the charges dropped, but the detective refused.

My mother was told by a lawyer that she can get 3-6 months because he says its a petty larceny(even though it was a mistake). ok heres the thing, my stepfather has a record because he previously did 13 yrs and he is still on probation, My mother Has a Clean record and has a past as a corrections officer.she was given a court date which was yesterday june 3rd and she was told she must wait 90 days.If she gets a letter she must appear again to court if not all is dismissed(i believe).My stepfather has a date to court on july 17. What do you think will happen? Since what happened was an honest mistake. Can they actually get time? or a fine? i would hope thier case is dissmissed. Sorry for the long post(it has been crazy the past few months).

This guy needs to testify and contact the DA and tell them what he said etc.

If he will confirm this, the case should be dropped.

Get a lawyer involved anyway to make sure this happens.

I found out a few days ago that the D.A called the boss and the boss said it was all an accident and wanted the charges dropped(which is what he told my uncle). So yeah hopefully this mess can be over soon. Thank you very much for your reply.
