Question court order-impact on activities

I Just recently obtained a court order for psychiatric evaluation for someone who criminally harassed me for 2 years(voice mail opened to the police, person sentenced 2 times in my case, and on both occasions..the individual did not resppect the conditions of her sentence). She has been exhibiting criminal behavior for the lasts 10 years (towards her employers, and former acquaintances). The party has 5 police files(that I know of). The last incident transpired in January 2008 where the individual called my office and started to speak with different individuals -says disparaging things about my person; the party acted on one of her threats by sending and email to where I work (contained disparaging comments)- this transpired on Jan 29 2008....the same night I went to the local police station to press charges...The office on duty adv me that "pressing charges again for this individual" was useless...suggested that I obtained the court order..which I obtained the next day (had been compiling evidence against this person for the last 2 years. The Party is extremely sick psychologically. What is the impact of the court order on this person's future activities. Everyone seems to think that the party's activities will be curtailed and that she will think twice before doing in further criminal activities towards my person.

Did you also get a restraining order keeping her away from you.

If you get that, she will be jailed if she violates it.

Question Re: court order-impact on activities

Thank you very much for your immediate response to my request. I am trying to put and end to this unfortunate situation. The court order that I obtained for this individual...I obtained by myself..I appeared in the court alone...I would like to to the same. I do not want to appear in the courtroom with this person. I have evidence as to her behaviour towards myself and others, I have the police files and the court hearing numbers. I would like to procede in the same manner?...The courthouse that I obtained the courtorder from..allows you to see a lawyer to make the request...How long will it take? and can I make a request to appear in court alone? Is it too late ..the last incident with this person was at the end of January 2008...thanks again

You normally can get it immediately if you have some kind of concern --

First a temp order can be given and then a permanent one if need be.

Question Re: court order-impact on activities

Thanks again for your extremely valuable information...The party in question has been sentenced several times for the exact same behaviour, and released because they "suffers from extreme mental illness", The fact that this person has been sentenced several times...Is this considered as having a criminal record?...What are their chances of landing a job. This person seems to have no trouble going across the border .This person seems to be able to get jobs as "cashier" and grocerly store clerk. Will she be able to have a carreer? ( because until I started enquiring on your site, I have not been impressed with the judicial system).

EEK! Re: court order-impact on activities

I don't know what state your in. But in New Jersey anyone who uses mental health as a "crutch" (excuse) in a criminal court ends up with at least some kind of psychiatric stipulations in their sentence-especially if they are put on probation. From what you are describing it sounds like "stalking" which is a combonation of harrassement and threats. Read into the laws regarding indictable offenses where your'e at and you will probably find that one only has to show up in the same place as someone 2 or more times combined with doing something threaten them to get charged with it.
