Recently I had a family member plead guilty to a crime. He said he plead guilty because his public attorney said it would be easier on everyone. He had his sentencing hearing and I was wondering what are the steps we need to take to retract his guilty plea now that it's after his sentencing? Any help would be appreciated. Thank you.

It is not easy to do so.
He has to show there was fraud involved or he clearly did not understand what was going on, counsel was ineffective and failed etc. That really has to be done with legal counsel to make sure the odds are maximized...it is not easy |
