Default NC suspension for 75 mph out of state

Hello,
First time poster, here. I received a letter from North Carolina, yesterday notifying me that my license will be suspended at the end of the week due to the fact that i had a ticket in Alabama for 76 in a 55 (was 70 mph about 10 feet prior to sign; construction zone). I looked on NC DMV website and saw that they can indeed suspend your license for any ticket above 75 mph.

My suspension states it is for 6 months with reinstatement fees, etc.

My question- I was not a resident of NC, nor did i have a NC drivers license at the time of conviction (September 2006, Alabama). I was a resident of Virginia and turned in my NC drivers license to Va DMV on 7/29/06. When i received the ticket however, i was a resident of NC (May, 2006). I did not fight the ticket due to the fact i would have to go to Alabama, etc, however i did not know this was all going to occur.

Can they still suspend my license? Will VA do anything about the NC suspension( i looked on Va site and they use a point system towards suspensions)? I can request a DMV in NC hearing to go over the case. 6 month suspension seems a little harsh for someone that hasn't had any tickets, etc for the past 14 years.

Any suggestions would be appreciated.

Thank you,
John

North Carolina DMV sucks @$$...trust me on that one. In most cases they will cross-report through the Driver's License Compact and your state license in your current state will be suspended. Additionally, most states will not un-suspend your license until after you have had the original suspension taken care of. Then you have to pay both NC and your state for the suspension.

Your best bet would be to get an attorney to fight it and keep NC from suspending it. If you are in Raleigh, and your hearing is in Raleigh, I would look at Karl Knudsen or John Fanney as solicitors. Both are great defense attorneys, but I really liked Mr. Fanney, his support staff, and his proximity to the court house.
