I received a ticket for speeding 67 in a 55. The vehicle information is completely wrong. It states a black VW Passat, while I drive a 1993 green Toyota Camry. The license plate # is also not correct.
There is also no signature by either the officer or myself on the ticket, although I'm not sure there is a place for either. The officer's badge # is there, but next to it is a field for "CCN#/ICR#" which is blank. Not sure what that is. Anyways, would this be any grounds for dismissal, or at least putting up a fight in court? The speeding was over a very short distance, so I was not even paying attention to the speedometer, as I was turning at the next light. I do not know what speed my instruments were reading. I live in a Twin Cities, MN suburb. Any help is greatly appreciated. Thanks! |

I wish to inform you that you can have your ticket dismissed. As the information is incorrect therefore you can argue that you were not at fault as ticket represent some other vehicle. Incorrect information is material to the ticket and hence the ticket can get dismissed. Further as there is no signatures thus this can also be argued that your vehicle was not the violating vehicle.

Is this going to be the only defense I need to prepare? I've seen in other threads people have said the judge would merely correct the misinformation. Is there a chance that would happen?

It sounds like the officer who wrote it up didn't know what he was doing. bring all the paperwork into court proving everything about the ticket is wrong, and the judge should throw the case out

Ask the court for a hearing on the matter. If it has missing elements such as a missing officer's signature or a signature that is hard to read or a missing or hard to read badge number, you should bring this up in court. Chances our these technicalities or others may cause the case to be dismissed.
