This Case will be tried on Tuesday, the 16th. I am planning my own defense, but first a backstory..
Approximately two years ago I was traveling down a small street located in between two shopping strips. This street has a slight bend before opening up straight approx. eighty yards to an intersection. I came out of the bend looking for a place to pull into to give my self a shot of insulin(type 1 diabetic). Forty yards before the intersection, I performed a U-turn feeling it safe as no traffic was coming or going down this small street. An officer immediately came out of an adjacent parking lot, pulled me over, and stated that I ran a red-light. I was stunned as I was over 100 ft away from the solid white line which designates the beginning of the intersection. It turned out I had an outstanding warrant for failure to sterilize an adopted animal(the cat was a present I got for my gf a few months back), the citys animal control later confirmed they never received the paperwork from the vet. My mistake for not following up. The redlight ticket is over two years old and is finally seeing its day in court. As I said, I'm defending myself. This case is unusual to defend for a variety of reasons. I see the ambiguity of the violation which reads ran red light, but refers to texas code 544.007 which states that an operator facing a steady red light shall remain standing unless turning right or given the signal to proceed. So the major obstacles of defense is -What constitutes facing a a steady redlight? -What distance constitutes facing a steady redlight? -Given my arrest, Will it be difficult winning over the jury? -Is a 200 yard view from the officers view a valid vantage defense? I appreciate any and all constructive opinions, as I'm confused in which direction to proceed with my defense. Thanks.. |
