What is required for a dismissal on the basis of fail to provide a speedy trial?

Some jurisdictions have actual number of day limits. But you can ask a judge to rule in virtually any case. What happened?

I was issued a ticket for leaving a controlled access highway. The fuel pump on my car needed to be replaced and I was having vehicular issues so I drove across the shoulder onto the service road - it was not a malicious act.

The ticket was issued in December 2005. I have been called to court on May 1st 2007 for the first time to face the charges.

I want the case to be dismissed based on Speedy Trial law. If this fails I want to request a reduced 'sentence' on the basis that it was not a malicious act on my behalf.

I want to focus this discussion on the Speedy Trial law/dismissal process.

At which point in the trial should the "Motion to dismiss" be made. Can you provide an example of the dialog that should be used?

Can someone please answer this part of the question also...

Does the motion need to be filed with the court prior to the hearing or can it just be presented to the court on the date the case is to be heard?
