Hello,
I'm a french student and I'm in Montreal for the fall semester. Last week I went on a trip in Ontario and I rented a car. On the Highway, I was doing 140 km/h using the cruise control (instead of 100). I got arrested by an officer who said that I was doing 153 km/h but I couldn't contest so my rental car was seized and my driver license suspended for one week in Ontario. I know I was wrong but as I was doing 140, I should have received only a ticket right ? The officer gave me a notice to go to the court on the 9th of december (I will still be in Canada at this time) but he told me that "we don't give a ****" if I didn't come to the court, and "we won't come after you". Moreover, he told me that if I went to the court, I would have to pay a 2000$ fine and if I didn't, I won't pay anything. I would like to know what I am facing if I don't go to this court, assuming that I leave Canada on the 23rd of december and the trial will proceed on the 9th (But I want to come back in Canada). If i appear, what are my chances to cancel the fine if I contest the officer's decision ? In case I don't appear, I would like to know if I will be authorized to come back in Canada later ? Than you in advance for your advices. |

Bonjour. Given your status as a student, coupled with the high speed alleged here, this is a pretty serious matter. The bottom line is that you need to speak with Canadian legal counsel to get accurate information and advice on the best way to handle this matter. Here is what I would suggest. Visit the WLD main page and request a referral -- they have qualified lawyers in Canada who have been called to the Bar and could help you. They can issue a warrant if you fail to address it. They may not do so but do you want to chance it.
Hire a lawyer if you have to. |
