I received a ticket in New York for having an expired insurance card. The officer wrote the ticket as "failure to present required document (insurance presented expired 4/8/09)". The officer then threatened me saying if I took this to court I would lose because he didn't say I didn't have insurance, but didn't provide proper insurance. And that by taking it to court and losing I could be charged a surcharge (not to mention wasting my time). My insurance policy is currently up to date and always has been.
NY Traffic code states: The owner of such motor vehicle shall maintain proof of financial security continuously throughout the registration period and his failure to produce proof of financial security when requested to do so by an officer shall be presumptive evidence of operating a motor vehicle without proof of financial security. Upon the production of proof of financial security such presumption is removed. Production of proof of financial security may be made by mailing such proof to the court having jurisdiction in the matter, and any necessary response by such court or acknowledgement of the production of such proof may also be made by mail. When insurance with respect to any motor vehicle, other than a motorcycle, is terminated the owner shall surrender forthwith his registration certificate and number plates of the vehicle to the commissioner unless proof of financial security otherwise is maintained in compliance with this article. Was the officer just trying to scare me? Is this worth fighting? |

Check the law but I think in NY you must have evidence with you at the time as well or there is still a charge possible.
