Default Need help ASAP please respond

Got a court date coming up and im wondering if i should even bother...

to keep a long story short, my brother was stopped in NJ for speeding...He did not have his license so he showed the cop my passport as identification...

They don't have my signature, the officer spelled both my first and last name wrong, they got no license number and i don't live in NJ...It's also worth noting my passport was renewed recently with a new number...

Should i bother showing up to court?

Forgot to add the vehicle he was driving was registered under Philadelphia plates in his girlfriends name...

Why isn't it your brother showing up in court? He showed false identification, and he should not have been in possession of your passport or anyone else's. How did he come to be in possession of your passport?

You must appear and explain that it was your brother and not you who was stopped and that he showed false identification. Otherwise, you are on the hook for something you are not guilty of.

Yes. bother to show up and speak with an attorney before going to your hearing.

My brother had my passport because i stupidly left it in the glove compartment of the vehicle when we went on trip to Montreal...I forgot to take it out when we got home which was an even dumber mistake...

My brother is planning on showing up to court to get the tickets amended under his name...Problem is i called the courthouse and they want me to show up along with him since the tickets are under my name but i really cannot take the day off work...We're under so much pressure to get this contract done that i cannot afford to take off unless i REALLY have to...

The officer is as much to blame for this mess as my brother is...I look absolutely nothing like my brother, the only thing physically we have in common is were both caucasian...On top of that the officer also got the name wrong so im convinced he's not all there if you know what i mean...

They have nothing really on me, all they have is a wrong name, my birth date and an old address...This is why im wondering if i should even bother showing up and plus as much as i would like my brother to pay for putting me in this mess i don't want him ending up in jail...I don't know about NJ law but giving an officer false information is a serious offense around my way...Of course if there is reason for me to worry about my ass ending up in jail for this its tough luck for him...

Were you personally served by an officer or the court for you to actually appear? In other words how do you know you have to go to court?

He got served with two tickets...

One for speeding and the other for driving without a license...

The second ticket requires a court appearance...

I did not sign anything...

I wasn't even in the state of NJ that night...

If you were not served with an order to appear then there is nothing to appear for.

That's my defense if they issue a warrant for failure to appear and it actually sticks to my records...They have to prove contempt and how can they do that if they have nothing on me but a birth date? I was never personally served with anything and they can't prove otherwise because they don't have my signature...They also misspelled my first and last name plus the vehicle is registered in a different state under someone else name...If they claim they sent something to the house, i never saw it...I think my defense is rock solid here plus i always have my brother ready to confess...

The way i see it, it is unreasonable to bust my balls when the person who really broke the law will do the right thing and be in court in an effort to clear this up...My brother will go to court on the said date and confess to what he did...If they don't approve because i am not present then screw them...

Am i wrong?

Personally, I would not appear under the circumstances that I understand. I would not confuse myself with all other circumstances that do not apply in the moment. I understand that you were not served by law to appear at any court coerced appearance.
