Default speeding - worh fighting

San Jose, CA

I was stopped for speeding on the freeway (max. 65 MPH), the officer stated that radar had me at (82 MPH). There were three or four cars in front of me going faster than I was at the time when we passed the CHP who was parked on the side of the freeway and was just getting into his car! I believe had finished giving someone a ticked and the next thing I know, I am being pulled over.

I have a good driving record, have not had a ticket in almost 18 years.
The only defense I have is where the officer was physically when passing him by. I will admit that I was going approx. 72-75 mph max. but not 82 mph.

I cannot afford my insurance to up nor do I want any points on my driving record!
Is it worth fighting and possibly winning or should I pay the fine and call it a day?

Thanks,
K

It is always worth fighting it if it is important to you---just by showing up you have some chance of prevailing.

I'm fighting mine. Not only is justice blind she is deaf and dumb as well, there is no justice only summary judgement.
