Default Got a speeding ticket while avoiding unsafe driver.

La Habra California
Today I got a speeding ticket for 59 in a 40 after trying to avoid a car that was creeping into my lane. We were the first cars to take off on a 2 lane street, there was traffic behind me so i didnt want to slam on the brakes and the cars front fender was at my door when they stared to creep over. So I hit the gas. Both cars were going up a hill and I dont think the motor cop saw the reason why I sped up, Since he was waiting at the top of the hill with his Laser. I never admitted fault while he was writing the ticket nor did I explain to him the situation as he is not a judge and he had his ticket book out right away. Is there any way to fight this ticket this would be my first one in 7 years of driving, I did feel that i was in danger of getting hit and I was only at that speed for a short amount of time. Or should I plead my case to the Judge and hope for a smaller fine and traffic school?

That is usually not an excuse the courts accept, but you can certainly try.

If you state your case to the traffic court judge you will be admitting you were, indeed, speeding. The law doesn't recognize any excuse for speeding, other than life or death emergency. And with that, you'd have to have your hazard lights flashing at the very least.

Since neither occurred, you're unlikely to beat this speeding ticket.
