Speeding ticket cop didnt show up to court
I got two speeding tickets on 1/13/08 in california I 5 north. My trial date was set for 8/7/08. I showed up for court (which is 290miles away from my residence) and the officers didn't. So I thought automatically my tickets would of been dismissed, the judge called my case and I go up, the judge explained to me that both officers werent there do to a high speed chase that was occuring that morning. He tried to get me to plead guilty and he would reduce the fine an one ticket. I still plead not guilty and he postponed the trial for thirty days. IS THAT A LEGAL REASON FOR NOT BEING THERE /DISMISSING THE TICKETS? And now i have to drive back there in thirty days and lose another day of work plus gas.

Get a damn traffic law expert and your auto club plan, if you have a good one will pay most if not all the cost. Representing yourself you have a fool for a client. What court is it and I will refer you to an attorney nearby. There is a website called www.tixnix.com thay can do this for you.

You needed to make a motion to dismiss the case in court due to a lack of a prosecution witness. No witness = no case....all the judge was trying to do was set another chance up for the officer to show up before you realize that you had already won. I'm not quite sure if you can still have it thrown out even though it was rescheduled

I also went to court and the judge dismissed my insurance ticket but he rescheduled me for the speeding ticket. I tought the tickets should of been dismissed at that time. Are you suppose to have a private court hearing and if on that day the cop doesnt show the tickets get dismissed? Or should they of gotten dismissed that same day when there were like 80 other people waiting for their turn?

THEY CAN AND WILL CONTINUE A TICKET IF THERE ARE EXIGENT CIRCUMSTANCES REGUARDING WHY THE POLICE OFFICER DIDNT SHOW UP.

Theoretically the case should have been dismissed. However, the judge had discretion because the cops did not show for a valid reason.
Personally, I would pay an attorney their $150 fee to handle this. They will postpone and postpone the ticket for a long, long time. Heck, sometimes they do it so long the cops are retired before it comes to court. These traffic attorneys are part of the “Big Wheel” and by taking this avenue, you will have several benefits. 1) This first thing is they will send you clear instructions to follow. 2) They will reschedule and reschedule so keep them up to date of a valid mailing address. 3) Since they are a part of the wheel, you are basically paying the judicial system. See, these lawyers wine and dine the DA’s and judges regularly. This is just my opinion but it sounds better than driving 300 miles and missing work. I am not sure of the traffic attorney fees in CA, but I can assure you it will be cheaper than driving, missing work and still the possibility of having the fines imposed. |
