Did I beat it 100%?
Ok, so here is the situation...
I was pulled over by the NY State Police for doing 79 in a 55 (work zone). I was speeding in a work zone and I was doing about 80, but keep in mind that construction on this particular area had concluded roughly three months prior to the speed trap that I was caught in. There were also people passing me while I was doing 80. This doesn't change the fact that I was breaking the law. So I pleaded not guilty in an effort to hopefully plead down the points & fines. I appeared in court, spoke with the Prosecutor, and he told me that my ticket would result in 8 points being assessed to my license. He said that the best he could do under the circumstances would be "failure to yield the right of way to a traffic control device" (essentially running a stop sign) and that this would result in only 2 points on my license. I thought myself lucky because I could just take a defensive driving class and clear the two points off my record. I signed off on the plead and waited to be called in front of the Judge. Now this is where it gets interesting, because the Judge asked me if I plead guilty to a parking ticket (a violation Section 1201-a of the NY State Vehicle and Traffic Laws). I was a little surprised because that is a 0 point ticket instead of the 2 point ticket I was expecting to get. I am not going to argue with a Judge, who for what ever reason (be it simple oversight or just pure luck) wants to plead down a ticket that was already pleaded down by the Prosecutor. I pleaded guilty to the parting ticket, paid the $100 fine and left. So this is what I need help with: There was, in my opinion, an error made by the court in the handling of my speeding ticket in that when speaking with the Prosecutor, I agreed to plead guilty to a 2 point violation and after speaking with the Judge, ultimately plead guilty to a 0 point violation. Can the court come after me on this, or is it a done deal? Thanks for the feedback and sorry for the lengthy post... ~Mactire~ |

A judge is the bigger hand than the prosecutor.
Youre clean But what is the parking fine about werent you booked for speeding? |

The speeding ticket was plead down to a failure to stop by the prosecutor, then plead down again to a parking ticket by the judge. So the end result was a $100 fine for the "parking ticket".
I am in agreement with you that the judge has the final say on the issue. Maybe I should look at this as the judge being nice instead of making a mistake? ~Regards~ Mactire |
