Hello everyone, I am a California resident who recently got a speeding ticket. I was in the passenger seat on the I-15; my sister was driving me and two friends. My sister is a diabetic and she has been her whole life, and while she was driving her blood sugar ran low and she started to feel dizzy. She pulled over to an exit and began to eat some food but still was in no condition to drive. So I, as the only person in the car other than my sister who was insured to drive the car, assumed the role of driver until we would reach out final destination in ontario and be able to more completely rest my sister. When I got back on the freeway I started to drive a little fast, partly due to my own recklessness and partly due to my sister's condition. I was traveling down a slope when I realized a cop was parked on the left side of the freeway, 3 lanes away from me. Once I saw the cop i immediately slowed down, wanting to avoid a ticket and any extra delay to our destination. The cop started up and tracked me down and handed me a ticket for going exactly 101 mph (no plus sign after 101) and violating my provisional license.
Now, I was planning on fighting this ticket on the grounds that I was going down a slope and the cop seemed to positioned at the very bottom of a slope on the freeway, seemingly in a speed trap which are illegal in California. Also he used a radar gun on me and I heard that they can be inaccurate and there was some distance between us to increase the inaccuracy. Also I know that I am allowed to drive people under the age of 21 in the case of a medical emergency. While my case did not exactly constitute a medical emergency, my sister was still in danger as low blood sugar levels can be fatal if left untreated. I was also planning on using trial by declaration to fight my case. Any advice anyone? |

Also by no means am I attempting to justify my actions. I was completely reckless and I have definitely learned my lesson. Since the incident I have stopped speeding completely and obeyed all rules of the road. I am just trying to figure out whether or not I can get my crime reduced to a regular speeding ticket due to the fact that I was 1 mph away from not receiving a 22348b. Also I wanted to know if trial by declaration was the best way to go. Any thoughts?

That defense of emergency is normally not acceptable unfortunately.
