Default Transit lane signposting

Applicable to Victoria, Australia.

In a transit lane on a freeway which is signposted for use by vehicles
carrying two or more "occupants", could you be penalised if the vehicle
contained the driver and four dogs ie 5 occupants? The sign only specifies
"occupants" not "people".
