Hawaii: Can an illegal immigrant file tax returns with fake ssn and name?

can an illegal immigrant with a fake social and name file tax returns? Im married to an illegal immigrant working under a fake ssn and name but we are working on getting him legal but not sure if we can file jointly or if he can't file at all. He hasn't filed taxes ever since he got here 7 years ago.

I wish to inform you that a person may not use a false ssn number or name because generally in all forms a person is supposed to provide correct details and providing incorrect details will lead to prosecution. Further using someother person name or ssn number can lead to charges of identity theft. There exists a liability to pay taxes but a person my not commit another wrong in this regard.

I know of many illegal immigrants that file tax returns in order to receive the child tax credit and they get back thousands of dollars-far more than they put in because of the exemptions and dependants they claim-every year. I think it's unfair, but they do it...
