Default Real Estate Write Off?

Hi,

I own a 2 family home in MA. I rent out the first floor and live on the 2nd. I also have 2 other roommates who are my tenants. My unit connects a 3rd floor and I have been investing all my extra money into turning this into the hopes of a 3rd unit. I have spend over 20K in 2008. I wanted to know if I can write any of this off, or can I only claim any work that has been done soley for my tenants on the first floor apartment????

Hi--yes you certainly can at least in part---but we normally do not give tax advice on this site; you may check with the IRS directly; or your accountant; or the H & R Block web site for 20 dollars: HR Block Tax Advisor link --

is legal fee accrued in mortgage modification deductable from my taxes
